1. Agreement to Terms
By accessing, browsing, or purchasing from DownShift ("DownShift", "we", "us", "our") via www.throttlendollars.com, you agree to be bound by these Terms of Service, Shipping Policy, Return & Refund Policy, and all applicable laws and regulations. If you do not agree, you must not use this website or purchase our products.
DownShift reserves the right to update or modify these terms at any time without prior notice. Continued use of the site constitutes acceptance of the updated terms.

You must be at least 18 years old to purchase from DownShift. By placing an order, you represent that you meet this requirement.
3. Products & Use Disclaimer
DownShift products include motorcycle apparel, protective-style garments, and motorcycle helmets. DownShift products are not certified safety equipment unless explicitly stated.
- Products are sold as-is and for lifestyle and riding use at the buyer’s own risk.
- DownShift makes no guarantees that products will prevent injury, harm, or death.
- You assume all risks associated with wearing or using our products.
DownShift is not liable for injuries, accidents, damages, or losses arising from use or misuse of any product.
Helmet Disclaimer (Daytona Helmets)
- Helmets sold on www.throttlendollars.com are Daytona brand helmets.
- DownShift does not manufacture these helmets and does not modify, alter, or inspect them beyond fulfillment.
- All liability, warranties, certifications, and safety claims related to helmets remain solely with the manufacturer.
- By purchasing a helmet, you acknowledge that DownShift is not responsible for fitment, certification standards, defects, recalls, or performance of the helmet.
4. Orders & Payments
- All prices are listed in USD unless otherwise stated.
- We reserve the right to refuse or cancel any order at our discretion.
- Orders may be canceled for suspected fraud, chargeback history, resale activity, or policy abuse.
- Once an order is placed, it cannot be modified or canceled.
5. Anti-Fraud & Scam Protection
To protect DownShift from fraud and scams:
- Orders flagged by our fraud prevention systems may be delayed, canceled, or refunded at our discretion.
- We reserve the right to request identity verification, billing verification, or additional documentation.
- Any attempt to falsely claim non-delivery, item not received, or unauthorized transactions may result in:
- Immediate order cancellation
- Account banning
- Evidence submission to payment processors and law enforcement
False chargebacks are considered fraud.
6. Force Majeure (Events Beyond Our Control)
DownShift shall not be held liable for any delay, failure, or interruption in performance resulting from events beyond our reasonable control, including but not limited to:
- Acts of God
- Natural disasters
- Pandemics or public health emergencies
- Supply chain disruptions
- Carrier delays
- Customs holds or inspections
- Labor strikes
- Government actions or regulations
- Power outages or system failures
Such events do not entitle the customer to a refund, cancellation, or chargeback.
7. Shipping Policy
Processing Time
- Orders typically process within 3–10 business days (excluding weekends and holidays).
- Limited drops, pre-orders, or custom items may take longer. Estimated timelines are not guarantees.
Shipping Transit
- Once shipped, delivery times depend on the carrier.
- DownShift is not responsible for carrier delays, weather issues, customs delays, or lost packages marked as delivered.
Address Accuracy
- Customers are responsible for entering the correct shipping address.
- Orders shipped to an incorrect address provided by the customer will not be refunded.
Lost or Stolen Packages
- If tracking shows "delivered," DownShift is not responsible for theft or loss.
- We strongly recommend shipping insurance where available.
8. Returns & Refund Policy (NO RETURN = NO REFUND)
ALL SALES ARE FINAL UNLESS A RETURN IS APPROVED IN WRITING.
No Return, No Refund Policy
- No refunds will be issued without a return.
- Items must be returned before any refund or store credit is considered.
- Claims for refunds without returning the item will be denied.
Return Eligibility
If approved, items must:
- Be unused, unworn, unwashed
- Have original tags and packaging
- Show no signs of wear, damage, odors, or alteration
Non-Returnable Items
The following are non-refundable and non-returnable:
- Limited drops
- Sale items
- Clearance items
- Custom or made-to-order products
- Items worn or damaged by customer
Return Window
- Return requests must be submitted within 7 days of delivery.
- Returns received after this window will be rejected.
Return Shipping
- Customer is responsible for all return shipping costs.
- Shipping fees are non-refundable.
9. Pre-Orders & Limited Drops
- Certain items may be sold as pre-orders or limited-release drops.
- Estimated ship dates are not guaranteed and subject to change.
- Pre-orders and limited drops are final sale and non-refundable.
- Chargebacks or cancellations for delayed pre-orders will be disputed.
10. Chargebacks & Payment Disputes
Customers agree to contact DownShift before filing a chargeback.
Improper chargebacks include:
- Claiming fraud after receiving the item
- Claiming non-delivery when tracking confirms delivery
- Filing disputes without contacting support
For such cases, DownShift will:
- Submit tracking, IP address, order confirmation, and communication records
- Permanently ban the customer
Excessive or fraudulent chargebacks may result in legal action.
11. Counterfeit & Anti-Resale Protection
- DownShift maintains zero tolerance for counterfeit production, unauthorized replicas, or resale of our designs.
- Any reproduction, imitation, or misuse of DownShift branding, logos, or product designs will result in legal action.
- We actively monitor marketplaces, social platforms, and websites for infringements.
12. Intellectual Property
All content, designs, logos, graphics, product names, and branding are the exclusive property of DownShift.
- Unauthorized use, copying, reproduction, or resale is strictly prohibited.
- Legal action may be taken against infringers.
13. Limitation of Liability
To the fullest extent permitted by law:
- DownShift shall not be liable for any indirect, incidental, special, or consequential damages.
- DownShift’s total liability shall not exceed the amount paid for the product.
14. Indemnification
You agree to indemnify, defend, and hold harmless DownShift, its owners, officers, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:
- Misuse or improper use of products
- Violation of these Terms or policies
- Fraudulent activity, chargebacks, or abuse of services
- Violation of any law or third-party rights
15. Mandatory Arbitration, Jury Trial Waiver & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy arising out of or relating to your use of www.throttlendollars.com, these Terms, or any purchase made from DownShift shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring an individual action in small claims court if eligible.
Jury Trial Waiver

Class Action Waiver

- You may bring claims against DownShift only in your individual capacity.
- You waive any right to participate in a class action, collective action, or representative proceeding.
- The arbitrator may not consolidate claims or preside over any form of class or representative action.
If the jury trial waiver or class action waiver is found unenforceable, the arbitration agreement shall still apply to the fullest extent permitted by law.
